Welcome to EIA (Echo Intel Agency), a hands-free mobile app for entertainment purposes only. By accessing or using our app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the app.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and EIA. We may update these Terms at any time, and your continued use constitutes acceptance of changes.

2. Eligibility

You must be at least 18 years old to use EIA. By using the app, you represent that you meet this requirement and comply with all applicable laws.

3. User Accounts

You must create an account with accurate information. You are responsible for maintaining the confidentiality of your password and all activities under your account. Notify us immediately of any unauthorized use.

4. App Features and Content

EIA uses AI for personality analysis, matching, and entertainment features like archetype detection and vibe dares. All AI-generated results are for entertainment only and not guaranteed accurate. You grant EIA a perpetual, royalty-free license to use your uploaded content (e.g., photos, videos) for app functionality.

Prohibited content includes: illegal material, harassment, spam, or anything violating third-party rights.

5. Privacy and Data Use

Our Privacy Policy (below) details how we collect and use data, including camera access, location, and biometric analysis for features like face mesh detection. By using EIA, you consent to such processing.

6. Prohibited Activities

  • Using the app for illegal purposes
  • Impersonating others
  • Harassing or harming users
  • Reverse engineering the app
  • Uploading malicious content

We may suspend or terminate accounts for violations.

7. Intellectual Property

All app content, trademarks, and technology are owned by EIA or licensors. You receive a limited, non-transferable license for personal use only.

8. Disclaimer of Warranties

EIA is provided "as is" without warranties. We disclaim all liability for AI accuracy, matches, or user interactions. Results are entertainment-only; no professional advice.

9. Limitation of Liability

EIA shall not be liable for any indirect, incidental, or consequential damages. Our total liability is limited to $100. This applies even if advised of potential damages.

10. Indemnification

You agree to indemnify EIA against claims arising from your use, content, or violations of these Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by Belgian laws. Disputes shall be resolved through Belgian courts, waiving class actions.

12. Termination

We may terminate your access at any time. Upon termination, your license ends.

12.1. Data Deletion

The "Burn" option in the app deletes all your data except your login account and restarts the assessment. To fully remove your account, send a message to echointelagency@protonmail.com from the email used for verification with the words 'terminate account'.

13. Miscellaneous

If any provision is invalid, others remain. No waiver unless in writing.

Privacy Policy

EIA respects your privacy and complies with GDPR, CCPA, and other laws. This Privacy Policy explains our practices.

1. Information We Collect

  • Biometric Data: Face mesh data, video/audio from camera/microphone for AI analysis (e.g., expressions, dares).
  • Usage Data: IP address, device info, app interactions, AI scores.
  • Derived Data: Attachment styles, match percentages from AI processing.

We collect this via Supabase for storage/auth, MediaPipe for face detection, and xAI Grok API for analysis.

2. How We Use Information

  • Provide features: Matching, archetype detection, vibe dares.
  • Improve app: Analytics, AI training (anonymized).
  • Security: Fraud prevention.
  • Communications: Updates, matches (with consent).

Biometric data is processed in real-time and not stored permanently unless for dares (videos stored in Supabase with your consent).

3. Sharing of Information

We share with:

  • Service providers: Supabase (storage), xAI (AI), RecordRTC (recording).
  • Matched users: Profile picture, attachment style, dares, phone (if shared).
  • Legal: If required by law or to protect rights.

No sale of data. International transfers comply with GDPR (e.g., Standard Contractual Clauses).

4. Data Security

We use encryption, access controls, and regular audits. However, no system is 100% secure.

5. Your Rights (GDPR/CCPA)

  • Access, correct, delete data.
  • Withdraw consent (may limit features).
  • Object to processing.
  • Data portability.
  • Opt-out of automated decisions (AI matching is entertainment-only).

Tous les résultats générés par l'IA sont à des fins de divertissement uniquement et non garantis précis. Vous accordez à EIA une licence perpétuelle, libre de redevances pour utiliser votre contenu téléchargé (p.ex., photos, vidéos) pour la fonctionnalité de l'application.

Contenu interdit inclut : matériel illégal, harcèlement, spam, ou tout ce qui viole les droits de tiers.

5. Confidentialité et Utilisation des Données

Notre Politique de Confidentialité (ci-dessous) détaille comment nous collectons et utilisons les données, incluant l'accès à la caméra, la location, et l'analyse biométrique pour des fonctionnalités comme la détection de mesh facial. En utilisant EIA, vous consentez à un tel traitement.

6. Activités Interdites

  • Usurper l'identité d'autrui
  • Harceler ou nuire aux utilisateurs
  • Rétro-ingénierie de l'application
  • Télécharger du contenu malveillant

Nous pouvons suspendre ou terminer les comptes pour violations.

7. Propriété Intellectuelle

Tout contenu de l'application, marques de commerce, et technologie sont détenus par EIA ou les concédants. Vous recevez une licence limitée, non transférable pour usage personnel uniquement.

8. Exclusion de Garanties

EIA est fourni "tel quel" sans garanties. Nous déclinons toute responsabilité pour l'exactitude de l'IA, les matches, ou les interactions d'utilisateurs. Les résultats sont à des fins de divertissement uniquement ; pas de conseil professionnel.

9. Limitation de Responsabilité

EIA ne sera pas responsable de tout dommage indirect, incidant, ou consécutif. Notre responsabilité totale est limitée à 100 $. Cela s'applique même si averti de dommages potentiels.

10. Indemnisation

3. Gebruikersaccounts

4. Appfuncties en Inhoud

U verleent EIA een eeuwigdurende, royalty-vrije licentie om uw geüploade inhoud (bijv., foto's, video's) te gebruiken voor de functionaliteit van de app.

Verboden inhoud omvat: illegaal materiaal, intimidatie, spam, of alles dat inbreuk maakt op rechten van derden.

5. Privacy en Gegevensgebruik

Onze Privacybeleid (hieronder) detailleert hoe we gegevens verzamelen en gebruiken, inclusief cameratoegang, locatie, en biometrische analyse voor functies zoals face mesh detectie. Door EIA te gebruiken, stemt u in met dergelijke verwerking.

6. Verboden Activiteiten

  • De app gebruiken voor illegale doeleinden
  • Anderen imiteren
  • Gebruikers lastigvallen of schaden
  • Reverse engineering van de app
  • Malware inhoud uploaden

We kunnen accounts opschorten of beëindigen voor schendingen.

7. Intellectueel Eigendom

9. Beperking van Aansprakelijkheid

EIA is niet aansprakelijk voor indirecte, incidentele of gevolgschade. Onze totale aansprakelijkheid is beperkt tot $100. Dit geldt zelfs als gewaarschuwd voor mogelijke schade.

10. Schadeloosstelling

U stemt in met het schadeloosstellen van EIA tegen claims die voortvloeien uit uw gebruik, inhoud of schendingen van deze Voorwaarden.

11. Toepasselijk Recht en Geschillenbeslechting

Deze Voorwaarden worden geregeerd door Belgische wetten. Geschillen worden opgelost via Belgische rechtbanken, met afstand doen van class actions.

12. Beëindiging

We kunnen uw toegang op elk moment beëindigen. Bij beëindiging eindigt uw licentie.

4. App-Funktionen und Inhalt

EIA verwendet KI für Persönlichkeitsanalyse, Matching und Unterhaltungsfunktionen wie Archetyp-Erkennung und Vibe-Dares. Alle von KI erzeugten Ergebnisse sind nur zu Unterhaltungszwecken und nicht garantiert genau. Sie gewähren EIA eine ewige, royalty-freie Lizenz zur Nutzung Ihres hochgeladenen Inhalts (z.B. Fotos, Videos) für die App-Funktionalität.

Verboter Inhalt umfasst: illegales Material, Belästigung, Spam oder alles, was Rechte Dritter verletzt.

5. Datenschutz und Datenverwendung

Unsere Datenschutzrichtlinie (unten) detailliert, wie wir Daten sammeln und verwenden, einschließlich Kamerazugang, Lage und biometrischer Analyse für Funktionen wie Face Mesh Detection. Durch die Nutzung von EIA stimmen Sie einer solchen Verarbeitung zu.

9. Haftungsbeschränkung

EIA haftet nicht für indirekte, zufällige oder Folgeschäden. Unsere gesamt Haftung ist auf $100 begrenzt. Dies gilt auch, wenn auf mögliche Schäden hingewiesen wurde.

10. Schadensersatz

Sie stimmen zu, EIA gegen Ansprüche freizustellen, die aus Ihrer Nutzung, Inhalt oder Verletzungen dieser Bedingungen entstehen.

11. Geltendes Recht und Streitbeilegung

Diese Bedingungen unterliegen belgischem Recht. Streitigkeiten werden durch belgische Gerichte gelöst, mit Verzicht auf Sammelklagen.

12. Kündigung

Wir können Ihren Zugriff jederzeit kündigen. Bei Kündigung endet Ihre Lizenz.

12.1. Löschung von Daten

Die "Burn"-Option in der App löscht alle Ihre Daten außer Ihrem Login-Konto und startet die Bewertung neu. Um Ihr Konto vollständig zu entfernen, senden Sie eine Nachricht an echointelagency@protonmail.com von der für die Verifizierung verwendeten E-Mail mit den Wörtern 'terminate account'.

13. Verschiedenes

Wenn eine Bestimmung ungültig ist, bleiben die anderen bestehen. Kein Verzicht, es sei denn schriftlich.

6. Datenschutz für Kinder

EIA ist für 18+. Wir sammeln nicht wissentlich Daten von Minderjährigen. Wenn entdeckt, löschen wir es.

Daten werden so lange aufbewahrt, wie für Funktionen benötigt (z.B. Profile bis Löschung). Biometrie transitorisch verarbeitet.
